The following concerns additional info is requested for whether / how TCB processing conforms with the
2.962(f)(1) requirement to fully apply rules and policies
1) Numerous places in the filing indicate part 90 for 775-776 MHz and 805-806 MHz.
As is well-known, in 2007 the rules changed thus now those frequencies are allocated and licensable in U.S. only
for part 27.
TCB please coordinate for updating relevant portions of the filing for associated 2.962(f)(1) conformity.
2) Numerous places in the filing indicate part 90 subpart R narrowband operations [90.541 rather than 90.542,
90.543(a) rather than 90.543(e), etc.] for 768-769 MHz and 798-799 MHz, including freqs. cover letter and
EMC/radio test reports.
As TCBs, labs, and applicants should be well-aware, in 2012 the rules changed thus now those frequencies are
allocated and licensable in U.S. only for Public Safety Broadband operation (FirstNet sole licensee; LTE).
TCB please coordinate for updating relevant portions of the filing for associated 2.962(f)(1) conformity.
Alternatively, please provide evidence of active license or waiver demonstrating U.S. part 90 subpart R
public-safety narrowband incumbent / legacy authorization for 768-769 MHz and 798-799 MHz; and/or update
freqs. cover letter for more detailed explanations of intended U.S. or non-U.S. operations.
3) Selected rule and policy/procedure excerpts follow, for reference / reminder.
DA-11-846 is example that waiver can be required for listing public safety narrowband oeprations on grants in
764-768, 768-769, 775-776, 794-798, 798-799, 805-806 MHz.

II. LICENSED TRANSMITTERS – GENERAL GUIDANCE

For clarifying its scope the frequencies available for licensed operations at the time of an equipment grant should be
identified and reflected by the FCC-731A listings and the contents of an equipment authorization, in terms of the §
2.106 spectrum allocations as well as the radio service rule blocks and channels available for the type of station
equipment.

The frequencies used in EMC/radio parameters testing and RF exposure evaluations must include allocated and
licensable frequencies under the applicable service rule.
Supporting information and operating descriptions must be clear and consistent across an application about device
frequency capabilities, frequencies tested, and frequencies available for subsequent FCC licensed operations.

(1) Test only on the allowed frequencies.
