Commission Decision and Summary
In a Memorandum Opinion and Order adopted on September 1, 2004, and released on September 9, 2004 (FCC 04-211), the Federal Communications Commission granted in part an Application for Review filed by PanAmSat Corporation. The Commission directed the Managing Director to issue an $83,720 filing fee refund to PanAmSat.
The decision reviewed previous rulings by the Office of Managing Director (OMD) that denied PanAmSat's request for a waiver and refund of the application fees paid for the PAS-8B satellite. While the Commission affirmed that OMD acted properly based on the limited record initially presented, it determined that supplemental information submitted on review demonstrated compelling and extraordinary circumstances warranting partial fee relief.
- Order FCC 04-211 adopted September 1, 2004, and released September 9, 2004.
- Fee Control No. 9810308210288001.
- Application for Review filed by PanAmSat Corporation on February 6, 2002.
Background of the PAS-8 and PAS-8B Filings
PanAmSat launched its PAS-8 Ku-band fixed-service satellite in late 1997. Following extensive power circuitry failures detected within five days of launch, the satellite suffered significant losses in payload capacity. To maintain continuous service to Latin America, PanAmSat sought authorization to construct, launch, and operate the PAS-8B replacement satellite, which possessed identical technical characteristics and operated at the same frequency bands and effective isotropic radiated powers (EIRP).
PAS-8B was launched under special temporary authorization on December 21, 1998, and commenced service in February 1999, at which point PAS-8 was removed from service and its communications payload turned off. In filing its replacement application, PanAmSat paid the statutory space station replacement fee of $89,460 and requested a waiver and refund, arguing that it should instead be assessed the significantly lower space station modification fee.
- Original replacement satellite application fee paid: $89,460.
- Space station modification fee rate: $5,740.
- Replacement project cost exceeded $200 million, with less than $30 million covered by insurance.
Procedural History and OMD Determinations
The Office of Managing Director issued a letter decision on August 1, 2000, and a reconsideration decision on January 7, 2002, denying PanAmSat's waiver request. OMD determined that PanAmSat had not met the required statutory burden under Section 8 of the Communications Act (47 U.S.C. 158) and Section 1.1117(a) of the Commission's Rules (47 C.F.R. 1.1117).
OMD noted that PanAmSat's initial filing merely claimed the satellite lacked full payload capacity without detailing the full extent of the technical failure or proving catastrophic in-orbit destruction. OMD also rejected the argument that fee schedules should be adjusted to match actual administrative processing burdens.
- OMD Initial Letter Decision: August 1, 2000.
- OMD Reconsideration Letter Decision: January 7, 2002.
- Ruling clarified that statutory application fees represent average estimates rather than actual per-application processing costs.
Commission Findings and Refund Authorization
Upon reviewing the full factual record, the Commission confirmed that statutory fees cannot be varied merely because an application requires minimal staff processing. However, the Commission endorsed the policy established in Hughes Communications Galaxy, Inc., assessing the lower modification fee when a replacement satellite is technically comparable to an authorized unit that failed prematurely under extraordinary and compelling circumstances.
The Commission found that the early failure of PAS-8's power system was not routine end-of-life replacement but an extraordinary failure requiring an urgent $200 million replacement to prevent service interruption. Concluding that public interest standards for a waiver under 47 U.S.C. 158(d)(2) were satisfied, the Commission ruled that PanAmSat should be assessed the $5,740 modification fee instead of the $89,460 replacement fee, granting a refund of the $83,720 difference.
- Waiver granted under Section 8(d)(2) of the Communications Act.
- Procedural rule 47 C.F.R. 1.115(c) waived in the public interest to permit new factual evidence.
- Total refund amount directed to PanAmSat Corporation: $83,720.
