Overview of the Erratum
On August 13, 2026, the Chief of the Federal Communications Commission's Office of Engineering and Technology (OET) released an Erratum to the Third Report and Order and Third Further Notice of Proposed Rulemaking (FCC 26-50) in ET Docket No. 21-232, originally released on July 23, 2026.
Issued under delegated authority pursuant to 47 CFR Sections 0.31 and 0.241, the Erratum conforms transition-date provisions, fixes typographical and paragraph-designation errors across Appendix A (Final Rules) and Appendix B (Proposed Rules), and replaces Appendix C (Final Regulatory Flexibility Analysis) in its entirety.
Key Adjustments to Compliance Dates and Final Rules
The Erratum corrects paragraph 76 and paragraph 245 of the Order to establish specific compliance dates for online point-of-sale FCC ID display rules under Section 2.803(c), while setting general rule effectiveness at 30 days following publication in the Federal Register.
- Section 2.803(c)(1) compliance date is specified as March 1, 2027.
- Section 2.803(c)(2) compliance date is specified as June 1, 2027.
- Appendix A adds compliance notes to Section 2.803(c) reflecting these March 1, 2027, and June 1, 2027 dates.
- Paragraph designations and cross-references are amended in Section 1.50001, Section 2.803(c)(3), Section 2.903(d)(2), Section 2.932, and Section 2.1204.
Proposed Rule and Textual Corrections in Appendix B
Appendix B is updated to correct section numbering, formatting, and specific rule texts governing online marketing, liable parties, and permissive changes for authorized covered equipment.
- The title for Section 2.804 is corrected to 'Online marketing of radiofrequency devices subject to an equipment authorization.'
- Section 2.909 formatting is reorganized to clearly designate liable party provisions under paragraph (b).
- Section 2.932(b) and Section 2.1043(m) clarify five conditions under which software, firmware, or hardware updates to already-authorized covered equipment do not constitute a request for a new equipment authorization and are treated as Class I or Class II permissive changes.
- Section 2.1204(a)(5) is designated properly for radio frequency devices imported solely for export.
Replacement of Final Regulatory Flexibility Analysis
The Erratum replaces Appendix C with a full Final Regulatory Flexibility Analysis (FRFA) addressing the economic impact on small entities.
The revised FRFA highlights modifications made in response to ex parte filings from industry groups such as the PASS Coalition, CTA, CCIA, eBay, and the National Retail Federation (NRF). These changes include limiting FCC ID displays to certified devices (excluding Supplier's Declaration of Conformity equipment), grandfathering existing listings, exempting used equipment and low-volume third-party sellers under the INFORM Consumers Act, and adopting a validity-only verification tier for non-custodial online marketplaces.
