Investigation of Interference in Eugene, Oregon

On July 18, 2016, the FCC Enforcement Bureau's Portland Resident Agent Office issued a Notice of Unlicensed Operation to Conveyered Aggregate Delivery Inc. (CAD) located in Eugene, Oregon.

The action follows an investigation initiated after the Portland Office received a complaint alleging an unlicensed radio station was operating on the Public Safety frequency 458.950 MHz from a construction site in Eugene, Oregon.

Enforcement Findings and Equipment Identification

On June 28, 2016, an FCC agent investigated the site and confirmed that Conveyered Aggregate Delivery Inc. owned and operated a Hetronic International Inc. transmitter bearing FCC ID LW9-CS458-TX. The transmitter was installed in a delivery boom truck with Oregon license plate number YCS441.

An FCC agent interviewed a CAD representative, who stated that CAD purchased the delivery truck with the transmitter included from a previous owner and was unaware of FCC licensing requirements. The representative agreed to discontinue operation due to ongoing interference. Commission records confirmed that CAD held no FCC license to operate on 458.950 MHz in Eugene, Oregon.

Regulatory Basis and Required Compliance Actions

Under 47 U.S.C. Section 301, radio stations must be licensed by the FCC unless operation falls under Part 15 rules. The Bureau noted that the Hetronic transmitter is authorized under Part 90.217 of the Commission's Rules for the 458.8–459.2 MHz band rather than Part 15, meaning an explicit Part 90 station license is required.

The FCC warned the operator that unauthorized radio operation violates federal law and may lead to substantial monetary forfeitures, equipment seizure (in rem arrest), or criminal penalties. CAD was ordered to immediately discontinue unlicensed operations and given 10 days from July 18, 2016, to submit proof of authorization.
