FCC OET Opens Public Comment Period on DJI Security Assessment Ex Parte Filing

The FCC's Office of Engineering and Technology has established an August 28, 2026 public comment deadline on an ex parte filing and security assessment report submitted by SZ DJI Technology Co., Ltd. under ET Docket No. 26-22.

An isometric illustration in shades of blue and cyan, with warm orange accents, depicts a stylized document unfurling from the center. The document is adorned with subtle icons representing radio waves, a flask, and a shield, suggesting themes of technology, testing, and security. Surrounding the document are interconnected lines and nodes, forming a network-like pattern, along with abstract representations of radio waves emanating outwards. Other small, conceptual icons like a gavel and a grid pattern are interspersed, hinting at regulation and structure. The overall aesthetic is clean and conceptual, avoiding specific devices or text.

Public Comment Window Opened on DJI Ex Parte Submission

On June 16, 2026, the Federal Communications Commission's Office of Engineering and Technology (OET) released a Public Notice (DA 26-592) opening an opportunity for the public to comment on a recent ex parte filing and cybersecurity assessment submitted by SZ DJI Technology Co., Ltd. (DJI). Interested parties must submit their comments by August 28, 2026, referencing ET Docket No. 26-22.

The submission stems from DJI's ongoing Petition for Reconsideration filed on January 21, 2026, regarding the Public Safety and Homeland Security Bureau's modification of the FCC Covered List to include all DJI communications and video surveillance equipment and services.

Background on Proceedings and Ex Parte Disclosure

In a previous Public Notice released March 6, 2026 (DA 26-223), OET designated the proceedings concerning DJI's Petition for Reconsideration and an Application for Review by Autel Robotics Co., Ltd. (ET Docket Nos. 26-22 and 26-23) as permit-but-disclose proceedings under Commission ex parte rules. That notice had established an April 6, 2026 deadline for oppositions and a May 11, 2026 deadline for replies.

Under 47 CFR ยง 1.1206(b), permit-but-disclose proceedings require written ex parte presentations and summaries of oral presentations, including any documents provided to staff, to be filed within two business days. On May 19, 2026, DJI representatives met with Adam Chan, Senior National Security Counsel to Chairman Brendan Carr, and Scott Noveck, Counsel, Appellate Litigation in the Office of General Counsel (OGC). During the meeting, DJI discussed a report evaluating two DJI drone systems, their controllers, and software applications to argue against inclusion on the Covered List.

Following a request by OGC staff, Adam Welsh, Head of Global Policy for SZ DJI Technology Co., Ltd., filed a formal notice of the ex parte presentation along with the OnDefend 'DJI Security Assessment (2026)' report on June 9, 2026, addressed to FCC Secretary Marlene H. Dortch.
