OET Order and Legal Authority
On February 12, 2026, the Federal Communications Commission's Office of Engineering and Technology (OET) released an order withdrawing the recognition of CVC Testing Technology Co., Ltd. (CVC) as an accredited test laboratory under Designation No. CN1282.
The action was taken pursuant to section 302(e) of the Communications Act of 1934, as amended, and section 2.951(d) of the Commission's rules. Commission regulations prohibit the recognition of, and mandate the withdrawal of recognition from, any test laboratory owned by, controlled by, or subject to the direction of a prohibited entity.
Ownership Structure and Prohibited Entity Determination
Under 47 CFR Section 2.902, prohibited entities include those identified as foreign adversaries by the U.S. Department of Commerce pursuant to 15 CFR Section 791.4, which includes the People's Republic of China (PRC). Section 2.902 defines ownership, control, or direction to include 10 percent or greater equity or voting control, the power to decide important matters, or direct/indirect supervision and control within a governmental structure.
Based in Guangzhou, China, CVC is a subsidiary of the China National Electrical Apparatus Research Institute Co., Ltd., which is a subsidiary of the China National Machinery Industry Corporation (Sinomach). Sinomach is a state-owned enterprise directly managed by the State Council of the PRC. In its October 14, 2025 response to the FCC's initial notice, CVC acknowledged that it is an independent third-party testing organization affiliated with a state-owned, publicly listed holding company.
Procedural History and Withdrawal Proceedings
The FCC established the proceeding under ET Docket No. 25-272 to evaluate CVC's recognition status:
Following CVC's failure to reply to the Order Instituting Proceeding, OET determined that the laboratory offered no evidence to demonstrate that it is not owned, controlled, or directed by the PRC.
- September 8, 2025: OET issued a Notice of Intent to Begin Proceedings to Withdraw Recognition (DA 25-799), tentatively finding CVC subject to PRC control.
- October 14, 2025: CVC submitted its response stating its affiliation with a state-owned holding company.
- October 24, 2025: OET issued an Order Instituting Proceeding (DA 25-932), providing CVC 35 days to demonstrate why its recognition should not be revoked.
- November 2025: CVC did not submit a response to the Order Instituting Proceeding.
Impact on Equipment Authorization and Test Data
CVC was accredited by the American Association for Laboratory Accreditation and last recognized by the FCC on June 12, 2024, with an expiration date of February 28, 2026. Since its initial accreditation in 2023, CVC performed compliance testing for approximately seven granted equipment certifications across scopes including unintentional radiators, ISM equipment, intentional radiators, U-NII devices, UWB, Commercial Mobile Services, and General Mobile Radio Services.
Effective immediately upon release of the February 12, 2026 order, the FCC will no longer recognize test data or measurements performed by CVC within its equipment authorization program.
