Overview of the Notice of Apparent Liability

On July 10, 2026, the Federal Communications Commission Enforcement Bureau adopted and released a Notice of Apparent Liability for Forfeiture (NAL) proposing a penalty of $25,000 against Delaware-registered Xtra Technology LLC (File No. EB-SED-26-00040495; NAL/Acct. No. 202632100011).

The proposed forfeiture follows the company's apparent failure to respond to an Enforcement Bureau Letter of Inquiry (LOI) issued on March 30, 2026. The LOI investigated whether Xtra had directly or indirectly marketed radiofrequency (RF) equipment in the United States that was placed on the FCC Covered List on December 22, 2025.

Inquiry Scope and Equipment Authorizations

The inquiry originated following public reports alleging that Xtra's digital 'action cameras' shared characteristics, hardware, or code with communications and video surveillance equipment listed under Section 1709 of the FY25 National Defense Authorization Act (NDAA), which became covered communications equipment.

Xtra applied for and obtained FCC equipment certifications between August and December 2025 for several digital camera models, identifying Fiona Miller as Certification Manager and designating its own Delaware address and email as the agent for service of process.

Delivery and Non-Response Findings

The Bureau transmitted the March 30, 2026 LOI via certified mail to Xtra's address of record in Wilmington, Delaware, and by email to the designated agent address. Although the certified mail was returned by the United States Postal Service marked 'not deliverable as addressed,' the Bureau received confirmation that the email delivery was successful on the same date.

The LOI ordered a full response within 30 calendar days (by April 29, 2026). Xtra failed to provide any response to the Bureau's LOI or subsequent communications, leaving the Commission without verified data regarding distribution channels, sales volumes, or hardware origin.

Forfeiture Calculation and Upward Adjustment

Under Section 503(b)(1)(B) of the Communications Act, a Commission LOI constitutes a binding agency order. While the standard base forfeiture for failing to respond to Commission communications is $4,000 under Section 1.80 of the rules, the Bureau determined that an upward adjustment to $25,000 was warranted.

The Bureau concluded that Xtra's non-compliance was egregious, intentional, and continuous, noting that ignoring agency inquiries regarding national security determinations and the Covered List compromises the Commission's statutory mandate to safeguard national communications networks.

Compliance Directive and Next Steps

In addition to the proposed $25,000 forfeiture, the Enforcement Bureau ordered Xtra Technology LLC to submit a complete and full response to the March 30, 2026 Letter of Inquiry within ten calendar days of the NAL release.

Xtra has 30 calendar days from the release date of the NAL to either pay the full proposed amount or file a written statement seeking reduction or cancellation supported by appropriate documentation.
