Regulatory Framework on Prohibited Foreign Adversary Entities

Under Section 302 of the Communications Act, the FCC establishes qualifications and standards for private measurement facilities that evaluate radiofrequency (RF) equipment for compliance with technical rules. Under rules established in the Bad Labs Order (ET Docket No. 24-136), the FCC ensures test laboratories participating in the equipment authorization program are not subject to ownership, direction, or control by entities that pose a national security risk.

Section 2.951(d)(1) requires the Commission to withdraw recognition of any laboratory that is owned by, controlled by, or subject to the direction of a prohibited entity under section 2.902. Section 2.902 includes entities identified as foreign adversaries by the U.S. Department of Commerce pursuant to 15 CFR § 791.4, which includes the People's Republic of China (PRC).

  • 10% or more equity, voting interest, or stock ownership or control constitutes ownership or control under 47 CFR § 2.902.
  • Possessing the power to direct or decide important matters qualifies an entity as subject to control or direction.
  • Being part of a governmental hierarchy or supervised by a prohibited entity bars lab recognition.

Background and Ownership Structure Findings

CVC Shenzhen, located in Shenzhen, China, received its initial accreditation in 2023 and was last recognized by the FCC on August 15, 2024, with an expiration date of April 30, 2026. Since 2023, the laboratory contributed testing for approximately ten equipment certifications.
